Terms and Conditions of Use

Limitation of Liability

Dublin AIDS Alliance CLG trading as HIV Ireland [hereafter HIV Ireland], its officers, directors, employees and volunteers shall not be liable for anything which may arise from or in any way connected with your use of the HIV Self-Test, this website and any information contained therein. HIV Ireland, including its officers, directors, employees and volunteers shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Product, the Website, and any information contained therein.

HIV Self-Test Kits

HIV Self-Tests are “Autotest VIH® [CE 0459] manufactured by AAZ-LMB, 43 rue de Bellevue 92100, Boulogne-Billancourt, France and supplied by Mylan, Newenham Court, Malahide Road, Northern Cross, Dublin D17 XC99, Ireland.

Before Use

Before using the HIV Self-Test check that the packaging is sealed and free from damage; the package contains all of the contents as outlined in the Instructions for Use; the package displays a valid CE mark (CE0459); the product is within the stated Expiry Date displayed on the exterior of the package.

About autotest VIH®

It is the sole responsibility of users of the autotest VIH® HIV Self-Test to be familiar with the instructions for use. Users are advised to note the Warnings and Precautions contained in the Instructions for Use in your pack before use. Use only as directed.

Your Data

All personal identifiable information collected and stored relating to you is used solely to enable us to provide the HIV Self-Test service to you. Non-identifiable statistical information may be used to help improve our services. HIV Ireland will be Data Controller for the purpose of running this website and the HIV Self-Test service.

Where provided, your name and address and any other identifiable and non-identifiable information, including health information, will be stored securely and not shared with any third party in accordance with data protection law and the General Data Protection Regulation (GDPR). Click & Collect

To collect a HIV Self-Test ordered through the Click and Collect service you must provide the One-Time Code you received by SMS when placing your order. Only the presentation of a valid code will authorise collection. HIV Ireland bears no responsibility for lost / misplaced codes.

A HIV Self-Test may be collected from the offices of HIV Ireland, 70 Eccles Street, Dublin, D07A977 during office opening hours 10am – 4pm, Monday to Friday (excluding public holidays).

Nothing in these Terms will limit the right of HIV Ireland to revise or otherwise change without notice or explanation the above stated hours and/or days when HIV Self-Tests may be collected.

The Click and Collect service will not operate where Government mandated restrictions on workplace closures relating to COVID-19 are in force.

Ordering multiple HIV Self-Test kits.

Only one HIV Self-Test may be ordered per person within a 6-week period from the date the order is placed.

Results Indeterminable

Users are directed to the information supplied with your pack in relation to test results. HIV Ireland cannot guarantee the accuracy, reliability, or readability of autotest VIH® HIV Self-Tests.   

If, for any reason, test results appear unreadable or in any way indeterminable please contact HIV Ireland to order a replacement test. To order a replacement test email: selftest@hivireland.ie or call 01 8733799 and ask to speak to a member of the HIV Self-Test Team.

Indemnification

By agree to these Terms and Conditions, You hereby indemnify to the fullest extent HIV Ireland from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

HIV Ireland is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

Assignment

HIV Ireland can assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you cannot assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between HIV Ireland and you in relation to your use of this Website and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of Ireland, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Ireland for the resolution of any disputes.
